Just what is “seditious conspiracy?”

That’s the latest count that’s been added to the list of federal charges against Arab resident Joshua James for his alleged role in the insurrection at the U.S. Capitol on Jan. 6.

Seditious conspiracy is the most serious of the charges against James and carries up to 20 years in federal prison if convicted.

James is one of 11 Oath Keepers who’s charged with seditious conspiracy following a new federal grand jury indictment that was announced last week.

By definition, seditious conspiracy is:

“If two or more persons in any state or territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.”

The charge is rarely used in federal court. In fact, the last time government prosecutors won a conviction on seditious conspiracy was in 1995, when Egyptian cleric Omar Abdel-Rahman and others were implicated in the first World Trade Center bombing and plots against other prominent U.S. landmarks.

Federal prosecutors say the Oath Keepers organized into teams that used training sessions to teach and learn paramilitary combat tactics for use on Jan. 6, 2021.

The goal was to hinder the Electoral College vote by force, according to the U.S. Department of Justice, which is prosecuting more than 700 people in the attack on the Capitol.
